# Supreme Court Orders DNA Tests for Indians Killed in Ukraine — What Delhi Really Doesn't Want You to Know
The Indian Supreme Court just admitted what the Ministry of External Affairs has spent months denying: our young men are coming home in body bags from Russia's war, and Delhi cannot even identify them.
On February 14, 2024, the Supreme Court bench ordered mandatory DNA testing for Indian nationals killed while serving in the Russian armed forces in Ukraine. The court also appointed a nodal officer to handle compensation claims. Translation: Delhi has corpses it cannot identify. Cannot count. Cannot answer to families. This is not bureaucratic inefficiency — this is systemic abandonment.
The pattern is now undeniable. Young men from Punjab, Haryana, and UP responded to WhatsApp recruitment ads promising 3 to 5 lakhs per month. They were told they would do security work. Instead, they were sent to Bakhmut — the deadliest frontline of the Ukraine war. Some came back in body bags. Most are missing. The MEA has no official number. No death toll. No transparency. When families demanded answers, they got silence.
This is not a diplomatic issue — it is a governance failure at the highest level. The Modi government prides itself on "Make in India" and "Skill India." But where is the "Protect in India" policy when young Indian citizens are being trafficked into foreign wars through recruitment rackets operating openly on WhatsApp?
The Supreme Court order exposes a fatal gap: the Ministry of External Affairs never signed a repatriation agreement with Russia. There is no treaty framework. No legal pathway for families to claim bodies. No compensation mechanism. No government accountability. This means every Indian family losing a son in Ukraine is fighting the state as much as they are mourning. They get no death certificate. No pension. No recognition. Just silence and DNA tests.
The deeper issue is constitutional. Article 21 guarantees protection of life. When the state fails to regulate illegal recruitment of Indian citizens into foreign armies, and then fails to identify or repatriate their bodies, it breaches that constitutional promise. The Supreme Court order is essentially saying: the government failed you, now we will fix it. But a DNA test is a band-aid on structural corruption.
Here is what stays buried in New Delhi offices: recruitment agents are still operating. WhatsApp groups are still active. They are still signing up young men. The government has not shut down a single recruitment network. Not one agent arrested. Not one case filed under the Foreign Enlistment Act of 1818 — the law that literally makes it illegal for Indians to serve in foreign militaries.
This is not incompetence. This is choice. These recruitment networks operate with tacit knowledge at district police levels. Some agents have connections to political networks. The MEA knew about Indian soldiers in Ukraine for months and said nothing. When confronted, they denied it. When DNA tests were ordered, they scrambled. This is not accident — this is pattern.
Expect the Modi government to frame this as "compassion through compensation." A few families will get payouts. The nodal officer will process claims quietly. But no recruitment network will be dismantled. No agent will face prosecution. No systemic reform will happen. Why? Because the government neither wants international diplomatic friction with Russia nor domestic political exposure of how many Indian youths are actually dying in Ukraine. The number itself is the real secret.
The DNA testing order is a court-mandated acknowledgment of state failure. Nothing more. Expect the government to use this order to appear responsive while the recruitment continues in WhatsApp groups that nobody in power is authorized to stop.
